GENERAL TERMS AND CONDITIONS OF “E. MIROLIO” LLC

For the use of the online store www.dika.rs

I. GENERAL PROVISIONS

This document represents the General Terms and Conditions for the use of the virtual platform for the sale of goods www.dika.rs and its subdomains, regulating the rules of use, including the conclusion of a sales contract with the e-shop. By placing an order on the website www.dika.rs, the customer declares that they are familiar with these General Terms and Conditions, accepts them as binding in relations with the Seller, and undertakes to comply with them.

Identification of the user/client for the purpose of delivering their statement regarding acceptance of the General Terms and Conditions, as well as for placing an order, is carried out by recording data in files stored on the server of www.dika.rs, including the IP address of the user/client and any other information.

2. DEFINITIONS

2.1. Seller: E. Mirolio d.o.o., with headquarters in Pirot, 181 Nikole Pašića Street, postal code 18300, Tax ID 110226280, Registration No. 21319988.

2.2. Client: Any natural or legal person or other legal entity using any DIKA online store in any way, including but not limited to browsing, ordering, purchasing, returning goods, etc.

2.3. Website: The virtual platform for the sale of goods located at www.dika.rs and its subdomains.

2.4. Account: A section of the website created by an email address and password, which allows the user to place orders and contains user information.

2.5. Favorites: A section of the account that allows the user/customer to create their own lists of favorite products.

2.6. Order: An electronic document representing a form of communication between the seller and the buyer through which the buyer declares to the seller, via the website, their intention to purchase goods and services from the website.

2.7. Goods and services: Any items subject to the sales contract on the website.

2.8. Promotions: Any commercial communication aimed at promoting certain goods and/or services offered in limited quantities, unless otherwise specified in the commercial communication, for a period determined by the seller.

2.9. Contract: A distance contract between the seller and the buyer for the purchase and sale of goods and/or services on the website, of which these terms of use are an integral part.

2.10. Content:
a) all information on the website accessible via an Internet connection and through the use of devices connected to the Internet.
b) information related to the buyer regarding goods and/or services and/or applicable tariffs by third parties with whom the seller has concluded a partnership agreement.
c) data about the seller or other data relating to them.

2.11. Refund: An action by “E. Mirolio” d.o.o. to return funds to the buyer as a result of termination or non-performance of the sales contract on the website, carried out exclusively via bank transfer.

2.12. Specifications: All characteristics and/or descriptions of goods and services as stated in the description provided by the manufacturer.

2.13. “User”: Any person who has accessed the website on their computer.

2.14. “Order”: All selected goods and all other attributes related to the delivery and payment of goods by the buyer/user.

2.15. The online store www.dika.rs is owned by the TRADER.

3. ORDER

3.1. The user may order from the online store by providing a valid email address, a correctly completed delivery address, and accurate contact details – name, surname, and phone number.

3.2. The buyer undertakes and is responsible for ensuring that all purchase data entered in the completed and submitted order is true, complete, and accurate up to the moment the order is sent.

3.3. Any goods and/or services added to the cart are available within the limits of available quantities. Adding goods and/or services to the cart does not constitute registration of an order or automatic reservation of goods/services. The order is activated by clicking the “Order” button and after the website loads all information related to the specific order (ordered items, delivery date, and address). This action is legally binding. The buyer receives an electronic notification (email) from:

with order confirmation, and upon receipt of this confirmation, the contract is considered concluded. The place of contract conclusion is the seller’s address. The place of delivery is a populated area within the territory of the Republic of Serbia. Contracts are not concluded or executed for delivery outside the Republic of Serbia.

3.4. After successfully placing an order, the user receives confirmation via email to the provided email address (“E. Mirolio” d.o.o. is not responsible if the buyer does not receive the confirmation email due to an incorrect email address or an error in the buyer’s email system). The confirmation email includes the ordered goods, order number, date, and time. Before confirming the order, the seller has the right to request clarification by phone if additional information is required. After that, the seller may accept or reject the order. Upon receipt of the confirmation email, the contract is considered concluded.

3.5. By submitting an order, the client authorizes the seller to contact them in any possible way when necessary in connection with the placed order or concluded contract. For contacting the user, the seller may use third parties, including commercial agents or assistants (call center, etc.).

3.6. The seller has the right to refuse to execute and/or cancel an already executed order if payment for the ordered products has not been received via online payment or if the data provided by the client is incomplete and/or inaccurate. In such cases, cancellation does not entail any liability or obligation for either party, and neither party is entitled to claim damages.

3.7. The seller reserves the right to unilaterally terminate the contract with the buyer via email from:

to the email address provided by the user, in the event that all or part of the ordered goods are out of stock or cannot be delivered for reasons beyond the seller’s control. If the ordered goods will not be available within one working week, the seller will notify the client via email. If payment has been made, the buyer may choose, via email, either a refund or replacement with another available product.

3.8. Goods purchased from the online store may be returned by the buyer to a DIKA store or sent at the user’s expense to the central warehouse within 14 working days from receipt. Products must be returned with a fiscal receipt or invoice, in new condition, with original tags and packaging, without dirt or traces of cosmetic products.

If the buyer wishes to exchange an item, they must complete the “exchange form.” The exchange is possible if the item/size is available. If the replacement item is of lower value, the difference will be refunded via bank transfer.

All return and exchange shipping costs are borne by the buyer. Goods must be returned with a return receipt; otherwise, “E. Mirolio” d.o.o. is not responsible for lost goods.

3.9. Refunds for returned goods are made via bank transfer within 14 working days from receipt in the central warehouse. The buyer must provide bank account details in the return form. The seller is not responsible for incorrect account details. For card payments, refunds are made to the same card. All bank fees are borne by the buyer.

3.10. If prepaid goods/services cannot be delivered, the seller will notify the buyer and refund the amount within 7 days from determining the issue or from the buyer’s request to terminate the contract.

3.11. The user may cancel an order within 14 working days without stating a reason, via phone or email. To be valid, the request must include: order number, phone number, name, email, order value, and a completed return form. Bank fees are borne by the buyer.

3.12. A complaint may be submitted if the goods do not comply with the contract, including:
a) manufacturing defect
b) incomplete delivery
c) delivery of incorrect goods
d) mismatch in size and/or color
e) damage during transport

3.13. Complaints must be submitted via www.dika.rs, and the goods must be returned within 14 days.

3.14. In case of complaint, the buyer may request replacement, exchange, or refund. If the new item is more expensive, the buyer pays the difference.

3.15. Transport costs for exchanges are borne by the client in both directions, except in case of seller error.

4. PAYMENT

4.1. The buyer pays the full price listed on the website. Partial payments are not accepted.

4.2. Payment is completed when received in the seller’s bank account or paid to the courier.

4.3. The payment method is selected during checkout.

4.4. Payment costs are borne by the client.

4.5. Payment methods:

Prices remain unchanged regardless of the payment method.

4.6. The buyer must pay the price valid at the time of order confirmation.

4.7. Bank and delivery costs are not included in the price.

4.8. Card payments are processed via AllSecure and AIK Bank using secure systems.

4.9. Card data protection is ensured via SSL encryption and PCI-DSS standards. Card data is not available to the seller.

4.10. Refunds are made to the same card used for payment.

4.11. All payments are made in RSD; foreign card payments are converted according to bank exchange rates.

5. DELIVERY

5.1. Delivery is carried out by courier within Serbia only.

5.2. Delivery is made only for confirmed orders.

5.3. Delivery time: 3–7 working days.

5.4. Delivery cost:

up to 5,000 RSD: 450 dinars. 

above 5,000 RSD: free

5.5. Orders sent to courier offices are held for 10 working days.

5.6. Customers may inspect goods before payment.

6. PERSONAL DATA

The seller collects and processes personal data (name, email, phone, IP) solely for order processing, communication, marketing (with consent), and legal compliance. Data is stored securely, retained up to 7 years, and not shared with third parties except when necessary or legally required. Users have rights to access, correct, delete, and object to processing. Requests must be submitted in writing.

7. GENERAL PROVISIONS

All goods are subject to availability. Product descriptions and images may differ from actual items. The seller may amend these terms at any time. Intellectual property belongs to the seller. Users may not misuse accounts or content.

8. FORCE MAJEURE

If force majeure lasts more than 14 days, either party may terminate the contract without liability.

9. OTHER PROVISIONS

Serbian law applies. The contract language is Serbian. Disputes are resolved amicably or by the competent Serbian court.
