GENERAL TERMS AND CONDITIONS DiKa LOYALTY PROGRAM
These general conditions ("General Conditions") regulate the relations between "E. MIROLIO" DOO and the user in relation to:
by participating in the loyalty program for DiKa™ brand products (hereinafter: "Program"),
issuing a user card for participation in the Program,
exercising the rights of the owner of the user card,
questions related to the Program.
By giving consent and registering to participate in the Program, the user confirms that he has read, understood and agreed to the General Terms and Conditions. After registering for participation in the Program, the user will be referred to as a participant in the following text of these General Terms and Conditions.
SCOPE The program refers to the purchase of DiKa™ brand products and products sold in physical stores of "E. MIROLIO" DOO under the name DiKa in the territory of the Republic of Serbia and products sold in the online store available at www.dika.rs (hereinafter : "Online store"), as well as the use of discounts for subsequent purchases according to the terms and conditions defined below.
2. PARTICIPANT IN THE PROGRAM. USER CARD
2.1. A participant in the Program can be any natural person of legal age and able to do business who has a permanent address in the Republic of Serbia.
2.2. Participation in the Program is voluntary.
2.3. Participation in the Program may be terminated at any time by the participant in the manner provided in point 4.2. 2.4. Participation in the Program is confirmed by a user card with content, design and functionality determined by "E. MIROLIO" DOO.
2.5. The User can register for participation in the Program when registering a user profile in the Online Store or when completing an order by marking the appropriate option for consent to registration in the registration form or on the page for completing the order ("check out"). After marking the appropriate consent option, the user receives a form for participation in DiKa physical stores to the e-mail address associated with his user profile. When purchasing as a "guest" in the Online Store, registration for participation in the Program is not possible.
2.6. During online registration, the user sends the form for participation in the Program to the e-mail online.bulgaria@dika.com. When registering through an order in the Online Store, the points collected from the first purchase are reflected in the user profile. When registering online for participation in the Program, the user receives a user card in the DiKa store he has chosen, or via courier delivery together with the completed order. The costs of delivery by courier service are borne by the user, if the user has not purchased DiKa products in a value that enables free delivery in accordance with the delivery conditions of the online store. Points collected in the Program can be used when making purchases in the Online Store without having a user card.
2.7. The user card is issued in the name of the participant and for his personal use. It can only be used on sales devices for products with the trademark DiKa™ in "E. MIROLIO" DOO.
2.8. Only one user card is issued per participant. In case of loss, destruction, damage or any other impact on the card that makes its use impossible, the missing /non-functional/ card is withdrawn from use and replaced with a new one. A participant with a non-functional card will be issued a new card with a new user number. If the user card is lost, destroyed, damaged or another influence applied to it that prevents its use, within 1 (one) year from the last issuance of the user card, the participant is obliged to pay a fee for the issuance of a new user card in the amount of 300 din . The points collected up to that point are transferred to the new card. If more than 1 year has passed since the first registration, a new card with a new user number is issued, the accumulated points are not transferred and the fee of 300 dinars is not paid.
2.9. The user card is not a security, it is not a document for verification and it is not allowed to dispose of the rights related to the card. The identification of the user card holder can be done by presenting a personal document for inspection by the employees of "E. MIROLIO" DOO who work in DiKa physical stores. "E. MIROLIO" DOO does not collect data from submitted personal documents or their copies in paper or electronic format. The personal document is only reviewed by an employee of "E. MIROLIO" DOO in order to identify the user, the holder of the assigned user card.
2.10. The user card is not a payment instrument, nor a tool for saving money, nor a document that enables the payment of existing funds/discount points in cash to the user.
2.11. Each user card, as an independent thing, is the property of "E. MIROLIO" DOO and remains their property until the end of the user's participation in the program.
2.12. The user card can only be used by the participant in whose name it was issued. It is not allowed to assign the card to third parties and/or transfer the rights it enables to a third party.
